Know Your Rights: Motor Vehicle Accidents and Workers’ Compensation / No Fault

DID YOU KNOW that if you are hurt in a car accident while working, you may seek compensation from the driver and owner of the vehicle that caused the crash, in addition to workers’ compensation benefits?  

What can I recover from the driver that caused the accident?  

Under New York law, you may seek compensation for your bodily injuries, past and future lost wages, past and future medical expenses, in addition to pain and suffering and other damages.

What benefits does Workers’ Compensation provide?  

Typically, worker’s compensation pays for your medical expenses and a portion of your lost wages.  It does not pay for any non-economic damages such as your pain and suffering.  

How long do I have to file a claim against the driver and owner of the vehicle that caused the car crash?

  • If you have a claim against a government agency, you must file your Notice of Claim within 90 days of the date of the accident and you must commence the lawsuit within a 1 year and 90 days.
  • If you have a claim against a private party, you have 3 years from the date of the accident to commence the lawsuit.

Workers’ Compensation Claim?

Workers must report their injuries within 30 days from the date of the accident and have up to 2 years to file a claim for work-related injuries.

Am I eligible to receive No-Fault benefits and Workers’ Compensation benefits?

No. Under New York laws, if you are injured while working, you will receive Workers’ Compensation benefits instead of No-Fault Benefits.  If you were not working at the time of the crash, you may seek No-fault benefits.  

Is there a deadline to file for No-Fault benefits?

Under New York Insurance law, you must submit your application for No-Fault benefits within 30 days of the date of the accident.
