Know Your Rights: Ambulatory (One Day) Surgery

KNOW YOUR RIGHTS: AMBULATORY (ONE DAY) SURGERY

When undergoing surgery, you may be admitted to a hospital for several days, or you may undergo an ambulatory surgery where you are discharged on the same day following the procedure.  Ambulatory surgeries/procedures may include liposuction, colonoscopies, endoscopies and laparoscopic procedures such as an appendectomy (removal of appendix); a cholecystectomy (removal of gallbladder); hysterectomy (removal of uterus) and liposuction (removal of fat tissue).

Following your surgery or procedure and prior to your discharge on that day, if you experience extraordinary abdominal or pelvic pain, a distended abdomen, or nausea and/or vomiting, you may have suffered injury to an internal organ or structure.

You should and must advise your doctor of your complaints prior to your discharge from the hospital or ambulatory surgery center.  An injury, including a perforation or a tear/laceration by a surgical instrument to one of your internal organs may have occurred during the procedure, and was not noticed by your physician.  Prompt diagnosis and treatment is critical to your health and wellbeing.

A diagnostic work-up or investigation to assess the cause of your complaints may include undergoing blood tests, x-ray, CT Scan, MRI, or ultrasound.  If you have sustained an injury during the course of the procedure to the bowel, bladder or other structure, your condition needs to be addressed immediately, most likely by surgery; otherwise bleeding or infection will develop that can lead to a very serious deterioration in your condition requiring additional substantial surgery, prolonged hospitalization with lifelong consequential injuries, and may even prove fatal.

If you have sustained an injury during a surgical procedure you may be the victim of medical malpractice.  Contact Sanocki Newman & Turret, so that we can evaluate your potential medical malpractice lawsuit.  You can call us at (212) 962-1190 or email us at info@sntny.com
